The owners of Benchmark Property Management (Yukon) Ltd are committed to providing transparency with respect to the collection, use and disclosure of personal information. This policy applies to our clients, website visitors and other individuals with whom we deal.
PIPEDA’s 10 fair information principles
In the Yukon as a non-public body we are governed by federal legislation, currently The Personal Information Protection and Electronic Documents Act (PIPEDA). This sets out the ground rules for how businesses subject to the law must handle personal information in the course of their commercial activities.
Principle 1 – Accountability
An organization is responsible for personal information under its control. It must appoint someone to be accountable for its compliance with these fair information principles.
Principle 2 – Identifying Purposes
The purposes for which the personal information is being collected must be identified by the organization before or at the time of collection.
Principle 3 – Consent
The knowledge and consent of the individual are required for the collection, use, or disclosure of personal information, except where inappropriate.
Principle 4 – Limiting Collection
The collection of personal information must be limited to that which is needed for the purposes identified by the organization. Information must be collected by fair and lawful means.
Principle 5 – Limiting Use, Disclosure, and Retention
Unless the individual consents otherwise or it is required by law, personal information can only be used or disclosed for the purposes for which it was collected. Personal information must only be kept as long as required to serve those purposes.
Principle 6 – Accuracy
Personal information must be as accurate, complete, and up-to-date as possible in order to properly satisfy the purposes for which it is to be used.
Principle 7 – Safeguards
Personal information must be protected by appropriate security relative to the sensitivity of the information.
Principle 8 – Openness
An organization must make detailed information about its policies and practices relating to the management of personal information publicly and readily available.
Principle 9 – Individual Access
Upon request, an individual must be informed of the existence, use, and disclosure of their personal information and be given access to that information. An individual shall be able to challenge the accuracy and completeness of the information and have it amended as appropriate.
Principle 10 – Challenging Compliance
An individual shall be able to challenge an organization’s compliance with the above principles. Their challenge should be addressed to the person accountable for the organization’s compliance with PIPEDA, usually their Chief Privacy Officer.
How we use Personal Information
We use the information about you to:
- Verify the identity of potential tenants and property owners;
- To assess suitability for tenancy;
- To ensure a high standard of service to our owners and tenants;
- To process specific requests and enquiries;
- To collect and process rent payments;
- To meet regulatory requirements;
- To contact and correspond with tenants, owners, suppliers and the general public regarding our services; and
- For any other purpose with your consent.
Right to withdraw
Subject to the operation of law, an individual can withhold or withdraw their consent for us to use his/her personal information in certain ways. This may restrict what services we can provide, but if this applies it will be explained to the individual to assist them in making their withdrawal decision.
Third party use of cookies and other tracking technologies
Whilst we do not engage in any collection of information about visitors to our site, third party providers including Google and Facebook may do so. We do not control third party tracking technologies, and should you have queries or concerns you should contact these companies directly. Security Measures
In line with the PIPEDA principles we have adopted a series of measures designed to physically safeguard your information, including:
- The use of locked filing cabinets;
- Securing offices where personal information is held;
- Using USER ID’s, passwords and other ESET Security to safeguard electronic systems;
- Restricting employee access to personal information that is not required to undertake their role; and
- Shredding documents and periodically deleting electronically stored information when it is no longer necessary for the purposes for which it was collected. For the avoidance of doubt we shall be entitled to retain information where required by law.

Requests to access or update information
Any request to access personal information must be made in writing to the Chief Privacy Officer and provide sufficient detail to identify the personal information being sought. We will use our best endeavours to provide the requested information within 14 calendar days or alternatively provide written notice of an extension request where additional time is required to comply. Should we be unable to comply in whole or part, we will notify the individual in writing and provide the rationale behind the decision.
You have the right to correct your personal data if it is not accurate or complete. These changes can be done through the Chief Privacy Officer.
